Success Stories: Immigrant Visa approved for Unmarried Daughter of U.S. Citizen at the Consulate in Guayaquil
We recently received an approval for an immigrant visa for an Ecuadorian national based on a family petition initially filed by her U.S. citizen mother, which was converted to a petition by her U.S. citizen sister. Congratulations to our clients!
Our clients initially came to us after their U.S. citizen mother petitioner passed away. As a result, the beneficiary’s immigrant visa petition was revoked by operation of law upon the mother’s passing. We filed a humanitarian reinstatement petition with the U.S. citizen sister stepping in as a substitute sponsor, which was approved. The petition was reinstated and the beneficiary was able to move forward with consular processing at the U.S. consulate in Guayaquil. She was recently called in for an interview and is now awaiting the issuance of her visa to be able to join her sisters who are all living in the United States.
Discretionary applications such as Humanitarian Reinstatement are not easily approved. We recommend seeking the assistance of an experienced immigration attorney who can help present your case in the best possible light and show that discretion is warranted in your case.
