The couple was recently approved for a marriage-based green card for the foreign spouse. Prior to the adjustment of status application, the applicant was the beneficiary of an O-1 extraordinary ability visa. Upon her marriage to her U.S. citizen spouse, the applicant was able to apply for permanent residency to live permanently with her spouse and their young child. At this time, many marriage based green card application interviews have been waived to address the years-long backlog. We had submitted evidence of a bona fide marriage at the time of filing and our clients’ interview was waived.
